Eliot Spitzer, New York state attorney general, has threatened to sue 17 coal-fired plants in Ohio, Indiana, Kentucky, Virginia, and West Virginia under the Federal Clean Air Act. The utilities, Mr Spitzer claims, modified older plants in ways that no longer allow them to qualify for protected ‘grandfathered’ status.
