In its complaint, DuPont alleged that SunEdison infringed its technology by sourcing and utilizing photovoltaic cells and solar modules featuring Samsung SDI front side metallization paste.
Neo Solar Power of Taiwan has been named as the cell manufacturer in the complaint. Flextronics was identified as SunEdison’s contract manufacturer.
DuPont Electronics & Communications global photovoltaic business marketing manager of microcircuit materials Peter Brenner said: "DuPont will enforce its patent rights to protect our substantial investment in innovation to improve solar energy efficiency.
"Installers and module makers like SunEdison are responsible for ensuring that their products do not use infringing cells or pastes. Our patented tellurium technology is available only from DuPont; no other photovoltaic paste manufacturer has a license to use our patented technology."
SunEdison declined to comment on the lawsuit, which was filed in the US District Court for the District of Delaware.
DuPont manufactures PV metallization paste products under the Solamet trade name.
The company said that it delivered new technologies to the solar industry with huge investments in research and development.
