The groups include PT Airwatchers, World Temperate Rainforest Network, No Biomass Burn, Olympic Forest Coalition and Olympic Environmental Council.

According to the appeal in the state Supreme Court, Sustainable solutions provider Port Townsend Paper is required to prepare an environmental impact statement before construction begins.

The facility is expected to burn wood waste from the company’s pulp and paper mill to produce about 25MW of electricity.

Responding to the appeal, the company stated that the appeals will delay construction until 2014 or 2015.

"The state Court of Appeals has now referred the case to the state Supreme Court, and if the Supreme Court agrees to hear the case, this will bring us a step closer to resolution," the company said in a statement.

The company has presently secured an 18-month extension for its construction permit as part of the appeal process.

Expansion at the biomass plant is projected require an investment of $55m.
