The coal-to-bio rejig at the 600MW Yorkshire facility’s second unit was overturned by the Department of Energy and Climate Change in April and one of the unit won backing.

The decision to refuse an early stage CfD has been quashed by the court and DECC, which was granted option to appeal, should reconsider the project.

In December, DECC shortlisted two conversion projects to receive subsidies but in April it said that only one was eligible, regardless of no changes to Drax’s project plans, according to Bloomberg.

Renews cited Drax as saying in a statement that, "The court has made a declaration that the second unit conversion was indeed eligible."
