Butamax Advanced Biofuels had sought and secured an order from the US District Court in Delaware that prohibited Gevo from selling bio-isobutanol to the automotive fuels market pending an appeal from Butamax.
Gevo executive vice president and general counsel Brett Lund said that the order now allows the company to sell its bio-isobutanol to anyone anywhere.
"We’re delighted that the Federal Appeals court sided with Gevo and reversed the status quo order, which we believe was wrongly granted,"
Lund maintained that the company had independently developed the technologies without ever infringing upon Butamax’s patents.
"We have independently developed the industry leading technologies that we believe are not covered by their patents and are more effective than their efforts," Lund said.
